Judge throws out $28M claim against Jack Warner

A High court judge has dismissed a lawsuit against senior cabinet minister and MP for Chaguanas West Jack Warner brought against the minister by former financier of the United National Congress (UNC), Krishna Lalla.

Lalla was seeking to recover $28 million which he contributed to the party for the 2007 general election campaign in which Warner and former UNC leader Basdeo Panday jointly held the leadership.

The case presented by Lalla was that his business provided a loan of $13,531,095, with a 12 per cent interest, making the final figure $28.1 million.

He claimed that there was an agreement with Warner for repayment of the loan in five tranches, ending by February 28, 2008. However the judge ruled that there was no reference to any demand made for repayment of the loan.

"Who were the parties privy to this loan agreement and who promised to pay whom by February 28, 2008?" the judge asked in his ruling.

"On that score, it seems very difficult, if not impossible, for the defendants to properly prepare to defend this action in a manner pleaded," he said.

Warner told the Express newspaper he feels vindicated by the result. "Justice has prevailed," he said. Warner stands to recover his legal fees in the matter and has promised to give it to charity.
