Former detainee takes legal action against state

One of the dozens of people arrested during the State of Emergency and later freed is suing the state.

Christopher Richardson, 19, one of the persons arrested on Nelson Street, Port of Spain on August 23 has sent a pre-action protocol letter to Attorney General Anand Ramlogan in which he has said he intends to take civil action against the State for wrongful arrest, false imprisonment and malicious prosecution.

The letter was sent through his attorney Criston Williams. The letter said when Richardson was arrested police advised him that they were conducting a profiling exercise and promised to release him once he provided his fingerprints to officers.

The letter said he cooperated and gave the prints at the Belmont Police Station, following which he was charged with being a gang member and imprisoned for 21 days under "harsh conditions at the Golden Grove Prison".

He and 20 others detained the same day were freed after Chief Magistrate Marcia Ayers-Caesar dismissed the case because the State did not offer any evidence to prosecute the men.

Director of Public Prosecutions (DPP) Roger Gaspard said there was insufficient evidence to secure convictions.
