No bail. Ish and Steve to spend Christmas in jail

High Court Judge Andre Mon Desir ruled Wednesday that businessmen Ishwar Galbaransingh and Steve Ferguson would not get bail, meaning they would have to spend Christmas behind bars.

Queens Counsel Andrew Mitchell, representing the defence, told the court he will appeal.

Mon Desir said in his ruling that attorneys for the men did not present convincing arguments that conditions had changed and the duo should be allowed bail.

"The leave merely crosses the threshold stage and there were no radical changes. There are no new changes of circumstances, the application for a change in circumstances is dismissed, bail refused and the status quo remains as is," Mon Desir said.

Mon Desir said the core argument used by the businessmen's attorneys centred around the change in circumstances following their June 15 incarceration. He said although new material was presented to the court the material presented was not relevant to the issue of bail.

Mitchell questioned Mon Desir's decision, saying that throughout the bail hearing the Office of the Attorney General had indicated they were neutral in the matter. Mitchell said this could only mean the State did not object to the bail application and as such that matter should be addressed.
