Ish, Steve lose at Privy Council; extradition matter back in TT court

Attorney General Anand Ramlogan has won his case in the Privy Council in the Constitutional Motion brought by Steve Ferguson and Ishwar Galbaransingh challenging the validity of the Extradition (Commonwealth and Foreign Territories) Act.

The businessmen had made an application with the Judicial Committee of the Privy Council seeking special leave to appeal the decision of the local Courts which had dismissed their Constitutional Motion against the State.

They that their case raised a point of law of general public importance. However, the Privy Council rejected the argument and ruled that no arguable point of law of general public importance arose to justify their appeal.

On Tuesday, the Law Lords announced that they have dismissed the application for special leave.

On the 9th October, 2010, Ramlogan ordered the extradition of both men to the United States where they face dozens of charges related to corruption during the construction of the new terminal at the Piarco International Airport.

They were given leave for the Judicial Review application to proceed. Their case will now be heard in the High Court on July, 2011.
