Law states foreigner cannot be police commissioner: Israel Khan

It seems that the laws of Trinidad and Tobago stipulate that only a citizen of Trinidad and Tobago can be appointed Commissioner of Police.

Senior Counsel Israel Khan told reporters Thursday based on that the Government must reject Canadian Neal Parker as the choice for Police Commissioner.

Khan backed up his statement with a reference to the Police Service regulations which establish Trinidad and Tobago citizenship as a requirement for the post.

He said that means the Police Service Commission (PSC) does not have the legal right to recommend a non-national to be appointed as Police Commissioner.

He said the PSC has the right to advertise internationally but it should state in its ads that only nations would be eligible for appointment to the post.

Khan said if the People’s National Movement (PNM) government wanted a foreigner to be a Commissioner of Police, it should have made that clear and pass the necessary laws in Parliament.

"What they have to do, they have to do the right thing. So if I am right, they cannot think about money and the legal process would be (that) they go back and look for a Commissioner of Police within the ranks," Khan said.

Once the law does not expressly forbid a foreigner from being appointed as police commissioner, then an appointment can be made.
