Jack writes Panday, demands documents to support charges against him

Jack Warner has written to the United National Congress (UNC) Leader Basdeo Panday challenging the party's right to hold a hearing without producing proper documentation to support alleged charges.

In the letter to Panday dated 31 July, 2009 the Chaguanas West MP noted that he presented the party at the aborted national executive meeting last Wednesday with a list of his legal demands, including details of all charges against him so that his legal counsel could study them in preparation for the cross examination of witnesses.


He said he also advised those present at the meeting that he would be unavailable on Aug. 6 and therefore the party cannot legally set that date for a hearing.

Warner had advised that he would be available later in the month and his letter offered to give alternative dates in August when he would be able to attend.


Warner reiterated that in his view the national executive does not have the legal authority to enquire into his conduct because they have not been duly elected in accordance with the UNC constitution.


"Their actions are illegal and in breach of the rules of natural justice for which each member who participated in the decision would be liable for punitive damage for breach of contract," the letter stated.

The UNC deputy leader made it clear that he is entitled to receive all the relevant documents, including minutes of the caucus meetings at which the members allegedly agreed on directions on votes in Parliament.


He said all this is necessary to allow him and his lawyers the opportunity to prepare for an enquiry.
